पर्यावरण एवं क्षेत्र के संरक्षक होने का दावा करने वाले समाजसेवी नेताजी आखिर क्यों है मोन यूजेवीएनएल परियोजना के बदहाल पुलों की रक्षा करेगा कौन

श्री पियुष गर्ग, विद्वान अधिवक्ता, याचिकाकर्ता WPPIL No.129/2024 के लिए; श्री योगेश कुमार पचोलिया, विद्वान अधिवक्ता, याचिकाकर्ता WPPIL No.204/2024 के लिए; श्री एस.एन. बाबुलकर, विद्वान महाधिवक्ता (वी.सी. के माध्यम से) तथा श्री सी.एस. रावत, विद्वान सी.एस.सी., उत्तराखण्ड राज्य की ओर से; तथा श्री विनय कुमार, विद्वान अधिवक्ता, UJVNL की ओर से सुनवाई हुई।
अनुपालन हलफनामे डॉ. रंजीत कुमार सिन्हा, सचिव, लोक निर्माण विभाग तथा श्री युगल किशोर पंत, सचिव, सिंचाई विभाग द्वारा दाखिल किए गए हैं।
सिंचाई विभाग के सचिव ने अपने हलफनामे दिनांक 13.10.2025 के पैरा-15 में कहा है कि उक्त सड़कों व पुलों के संचालन, मरम्मत या रखरखाव की कोई जिम्मेदारी सिंचाई विभाग की नहीं है। पैरा-15 का उद्धरण इस प्रकार है:-
“15. That as per the aforementioned correspondences and transfer orders, the entire stretch comprising nine (9) bridges and approximately 18.09 kilometers of service roads formally handed over to the Public Works Department, Dehradun as of 13.08.2025. Consequently, the Irrigation Department bears no responsibility whatsoever for the operation, repair, or maintenance of the said roads or bridges. It is further submitted that, in terms of Government Order No.1169/11(2009)-03(45)/2009 dated 21.04.2010, the operation and maintenance of the Dakpathar Barrage (including the Dhakrani and Dhalipur Power Houses), Asan Barrage (including the Kulhal Power House), Head Regulators, Kash Regulator, Powerhouse Canal, and other associated structures have, since then, remained under the jurisdiction and control of Uttarakhand Jal Vidyut Nigam Limited (UJVNL).”
लोक निर्माण विभाग के सचिव ने दिनांक 29.09.2025 के अनुपालन हलफनामे के पैरा-3 में निम्नलिखित निवेदन किया है:-
“3. That in compliance of the oral directions issued by the Hon’ble Court, it is submitted that the work of retrofitting of 42 m span RCC Skew Bridge located at Dhalipur Power Channel (Shakti Nahar) in Vikasnagar Assembly constituency has been completed by the department on 11.02.2025 and the Bridge Load test has been conducted by “ASCOM BUILDCON PRIVATE LIMITED” (A Specialized Engineering & Construction Company) and the company has also issued a certificate in this regard to the Executive Engineer, Construction Division, PWD, Dehradun on 13.02.2025. As per the issued certificate, the said Skew Bridge is fit for plying of heavy vehicles. In this regard, the Executive Engineer, Construction Division, PWD, Dehradun and Superintending Engineer, Ninth Circle, Public Works Department Dehradun also issued a certificate on 24.9.2025, mentioning that as per the said Bridge Load Test, the Skew Bridge is fit for plying of the heavy vehicles for Class A Single Lane Loading (more than 7000 Kg.)”
लोक निर्माण विभाग के सचिव द्वारा पैरा-3 में दिए गए निवेदन के दृष्टिगत, हम धलीपुर पावर चैनल (शक्ति नहर), विकासनगर विधानसभा क्षेत्र में स्थित 42 मीटर स्पैन आरसीसी स्क्यू ब्रिज पर वाहनों के आवागमन की अनुमति एक वर्ष के लिए देते हैं। तथापि, यह स्पष्ट किया जाता है कि सचिव, लोक निर्माण विभाग, सचिव, सिंचाई विभाग, प्रबंध निदेशक, UJVNL, ASCOM BUILDCON PRIVATE LIMITED, कार्यकारी अभियंता, निर्माण मंडल, लोक निर्माण विभाग, देहरादून तथा अधीक्षण अभियंता, नवीं वृत्त, लोक निर्माण विभाग उक्त स्क्यू ब्रिज पर होने वाली किसी भी दुर्घटना के लिए जिम्मेदार होंगे।
आवेदक की ओर से विद्वान अधिवक्ता श्री शंकर अग्रवाल ने IA No.2/2025 वापस लेने की अनुमति मांगी।
निवेदन को रिकॉर्ड पर लिया गया।
IA No.2/2025 वापस लेने के रूप में खारिज की जाती है।
